1. Agreement to Terms
Welcome to BE Survey. These Terms and Conditions form a legally binding agreement between you ("User," "Client," "Company Admin," or "Participant") and BE Survey ("Platform," "We," "Us," or "Our"). This agreement applies whenever you visit, open, register, log into, or use any page, service, database feature, or tool provided by BE Survey.
By creating an account, clicking "I Agree," or simply accessing or using our website and services, you confirm that you have read, understood, and agreed to obey all rules set out in this document. If you do not agree with any part of these Terms and Conditions, you must stop using BE Survey immediately and log off the platform.
2. Description of the BE Survey Platform
BE Survey provides cloud-based survey management software designed for companies, organization leaders, human resource departments, and administrative teams. The platform enables organizations to build survey forms, publish questionnaires, distribute feedback requests, collect responses securely, process analytics, and generate detailed data tables and management reports.
We continually upgrade, modify, and improve our services. BE Survey reserves the right to update system features, change layout views, modify background SQL procedures, update security controls, or optimize system performance at any time without prior notice.
3. User Eligibility and Account Creation
To use BE Survey, you must meet basic eligibility standards and follow our registration guidelines:
- Age Limit: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account or administer company accounts.
- Accurate Information: When registering a company, creating an administrative profile, or setting up a user account, you must provide real, accurate, complete, and current information. Using fake names, disposable email addresses, or misleading company details is strictly prohibited.
- Organization Representation: If you register an account on behalf of a business, enterprise, institution, or organization, you represent and warrant that you have full legal authority to bind that entity to these terms.
4. User Roles and Account Governance
BE Survey operates on a strict multi-level role system. Every user account belongs to a specific authorization level with distinct rights and limits:
A. Super Administrators
Super Administrators have complete system-wide access across all tenant databases, company records, background log files, and global configurations. Super Administrators can create new company accounts, edit existing company details, enable or disable company access, adjust system schemas, and oversee overall platform health.
B. Company Administrators
Company Administrators manage accounts within their assigned organization. They can create internal user profiles, design survey questionnaires, review submission analytics, export report tables, and assign role permissions to standard employees. Company Admins are fully responsible for ensuring that all users within their organization follow these terms.
C. Standard Users and Participants
Standard Users and Survey Participants are authorized employees or respondents granted access to fill out assigned surveys, view authorized reporting panels, or update their basic profile settings. Standard users must operate strictly within the boundaries set by their Company Admin.
5. Account Security, Passwords, and Authentication
Maintaining account security is a shared effort between you and BE Survey:
- Password Protection: You are responsible for keeping your account password, security questions, and One-Time Password (OTP) verification tokens completely confidential. Do not share your login credentials with colleagues, assistants, or third parties.
- Unauthorized Activity: You are fully responsible for all actions, updates, data entries, and administrative changes performed under your user account credentials.
- Immediate Reporting: If you suspect that your password has been guessed, stolen, or compromised, or if you notice unauthorized login attempts on your dashboard, you must notify your Company Administrator or BE Survey support immediately.
6. Acceptable Use and Prohibited Conduct
You agree to use BE Survey solely for legal, ethical, and authorized business survey purposes. You must follow these strict rules of conduct:
- No Illegal Activity: You must not use our platform to run illegal activities, distribute fraudulent forms, collect prohibited personal data, or violate local, national, or international laws.
- No Offensive Content: You must not publish or send survey questions or content that is abusive, discriminatory, hate-driven, obscene, harassing, or defamatory.
- No Hacking or System Attacks: You must not attempt to hack, breach, probe, test, or scan our network vulnerabilities, database procedure endpoints, server APIs, or authentication systems without express written consent.
- No Automated Scraping or Bots: You must not use automated scripts, bots, spiders, or web crawlers to submit bulk survey answers, harvest email addresses, or strain server infrastructure.
- No Impersonation: You must not pretend to be another person, company admin, employee, or system support agent.
- No Cross-Tenant Access: You must not attempt to bypass database boundaries to view, edit, or delete survey data belonging to another company.
7. Data Ownership and License Rights
Understanding who owns data on BE Survey is straightforward:
A. Client Data Ownership
Your organization retains 100% ownership of all custom survey questions, participant lists, uploaded assets, and survey response data that you enter or collect through BE Survey. We do not claim ownership of your survey content.
B. License to BE Survey
By uploading or submitting content to BE Survey, you grant us a worldwide, royalty-free, non-exclusive license to host, back up, store, process, display, and format your data solely for the purpose of operating, rendering, and maintaining the service for you.
C. Platform Intellectual Property
All software code, database design, HTML templates, CSS styles, JavaScript files, graphics, workflows, stored procedure logic, logos, and trademarks associated with BE Survey belong exclusively to BE Survey and its licensors. You are not granted any rights, titles, or licenses to our underlying code or intellectual property.
8. Service Fees, Subscriptions, and Payments
Access to BE Survey features is provided according to your agreed subscription plan, enterprise license agreement, or contract terms:
- Payment Terms: Company accounts must pay all applicable fees on time according to their chosen billing schedule (monthly, quarterly, or annually).
- Fee Changes: We reserve the right to adjust subscription rates or feature pricing plans. Price updates will be communicated to Company Admins prior to renewal cycles.
- Late Payments and Suspension: If subscription fees are unpaid or overdue, BE Survey reserves the right to temporarily suspend account access, freeze survey form publishing, or restrict dashboard reporting tools until balances are resolved.
9. System Availability, Uptime, and Maintenance
While we strive to keep BE Survey available 24 hours a day, 7 days a week, uninterrupted uptime cannot be guaranteed. Systems require regular routine maintenance, software upgrades, database re-indexing, server restarts, and security patches.
BE Survey is not liable for temporary service interruptions, network outages, cloud provider server downtime, or internet connectivity issues beyond our reasonable control. Whenever possible, scheduled maintenance windows will be announced in advance.
10. Account Suspension and Termination
We reserve the right to restrict, suspend, or permanently cancel your account access under the following conditions:
- Terms Violation: If you violate any rule in these Terms and Conditions or our Acceptable Use Policy.
- Security Threats: If your account is detected making unauthorized database calls, attempting injection attacks, or threatening system stability.
- Non-Payment: Unresolved payment defaults following notice.
- Legal Orders: In response to valid requests from legal authorities, court orders, or law enforcement agencies.
Upon termination, your right to use the platform ends immediately. You may request an export of your survey data prior to account closing, subject to subscription agreements and legal data rules.
11. Disclaimer of Warranties
BE Survey is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent allowed by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise—including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and error-free operation. We do not guarantee that survey results will meet your specific business objectives or that data input by respondents will always be accurate.
12. Limitation of Liability
To the fullest extent permitted by applicable law, BE Survey, its owners, directors, developers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes loss of profits, loss of business revenue, corrupt or lost survey data, cost of replacement services, or system downtime resulting from your use of, or inability to use, our platform.
13. Indemnification
You agree to defend, indemnify, and hold harmless BE Survey, its directors, developers, and employees from and against any claims, liabilities, losses, damages, costs, or legal fees resulting from your misuse of the platform, violation of these terms, or infringement of any third-party rights through content uploaded into your survey account.
14. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with applicable laws, without regard to conflict of law principles. Any dispute, legal action, or claim arising out of or relating to these terms shall be settled through good-faith negotiation or brought exclusively before courts of competent jurisdiction.
15. Severability and Complete Agreement
If any section, clause, or provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable by a court of law, that specific portion shall be separated, while the remaining sections will continue in full force and effect.
These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BE Survey regarding your use of the platform.
